Abstract

The translation of constitutional guarantees into substantive professional reality remains a critical frontier for corporate governance frameworks and digital economy landscapes in India. This article focuses on the socio-economic status of transgender professionals in Corporate India, analysing the shift in structure from an inflexible biological binary system to a flexible legal structure. Though the early landmark judgments placed gender identity within the Fundamental Rights of Part III of the Indian Constitution, applying such mandates to the organizational context of private firms continues to create a gap between the progressive legislation and existing procedural practices. This analysis reviews the regulatory framework of the Transgender Persons (Protection of Rights) Act, 2019, alongside the changes introduced by the Transgender Persons (Protection of Rights) Amendment Act, 2026.This examination will focus on judicial guidelines for substantive reasonable accommodation that have been defined by the apex court. The study considers the structural obstacles labour laws, organizational compliance mechanisms and takes the discussion beyond superficial measures of diversity and explains how private sector entities can incorporate equity into their structures to realize the constitutional transformation of dignity, equality, and economic justice in the organized labour sectors of the country. Keywords: Corporate governance frameworks, Fundamental rights, Transgender Persons Act, organizational compliance mechanisms, Economic justice
