Abstract

The Indian Constitution guarantees Fundamental Rights as essential safeguards against arbitrary State action and as foundations of individual liberty and dignity. However, constitutional guarantees acquire meaningful value only when they are effectively enforceable. This article examines the evolving role of the Indian judiciary in transforming Fundamental Rights from textual guarantees into practical and enforceable rights. It traces the development of judicial review and constitutional remedies under Articles 13, 32 and 226, with particular focus on the evolution of Article 21 through landmark decisions such as A.K. Gopalan, Maneka Gandhi, Vishaka, K.S. Puttaswamy and Navtej Singh Johar. The article further analyses Public Interest Litigation and judicial activism as mechanisms that have expanded access to constitutional justice and strengthened rights protection. At the same time, it critically examines concerns of judicial overreach, separation of powers and institutional limits. It argues that effective rights protection requires both robust judicial enforcement and principled judicial restraint.
