Abstract

The digital era has revolutionized communication, transforming passive internet users into active creators and democratizing global public discourse through social media. However, this rapid expansion prompted severe legislative overreach via Section 66A of the Information Technology Act, 2000. Intended to curb online harassment, the provision criminalized sending "offensive" messages. Due to its vague and overbroad terminology, law enforcement frequently weaponized the statute to suppress political satire, legitimate dissent, and peaceful journalism through arbitrary arrests. This authoritarian trend was decisively halted by the Supreme Court of India in Shreya Singhal v. Union of India (2015). The Court struck down Section 66A in its entirety, declaring it a direct violation of the fundamental right to free speech under Article 19(1)(a). This watershed ruling established that constitutional protections apply equally to the virtual world, safeguarding the internet as an open, democratic forum.
